Permits Expiration Changes Under HB 803

Effective July 1, 2026, Florida law changes how permit expiration dates are calculated. 

In general, permits issued on or after July 1, 2026, will expire one year after issuance or on the effective date of the next edition of the Florida Building Code, whichever is later.

Because Florida Building Code updates occur on a statewide cycle, permits issued during certain periods may have expiration dates that extend beyond one year from issuance.

Important: Permit expriation dates may be extended by passing inspections in accordance with Florida Building Code and County procedures. 

Note: The expiration dates shown above are based on the Florida Building Commission's curently anticipated Building Code update schedule. Future code adoption dates may change and could affect permit expiration calculations. 

Notice Regarding Changes to Section 381.0065. Florida Statues
  • Effective July 1, 2026, homeowners and builders of single-family residence may not be required to obtain an approved permit for an Onsite Sewage Treatment and Disposal System (OSTDS) from the Florida Department of Health before a building permit or plumbing permit is issued.
  • When Applying for a building or plumbing permit for a single-family residence that requires an OSTDS permit, the owner or builder must provide a receipt from the Florida Department of Health showing that an application for the OSTDS permit has been submitted.
  • If construction of the OSTDS begins before the Florida Department of Health issues the OSTDS permit, the property owner or applicant assumes all legal, financial, and safety liabilities associated with such construction. 
Permit Exemptions Under HB 803

HB 803 establishes permit exemptions for certain minor interior alterations valued at $7,500 or less in structures located outside Special Flood Hazard Areas. Charlotte County's existing permit exemptions are generally less restrictive and do not include a dollar-value threshold. Please review the table below to determine whether a permit is required for your project.

Private Provider Registration Requirements Under HB 803 – Effective July 1, 2026

Pursuant to changes enacted by House Bill 803, all private providers and private provider firms performing services within the County's jurisdiction must register with the local enforcement agency before contracting to provide services.

The County has established an electronic registration system that allows private providers and private provider firms to register and update their information online. During registration and any subsequent updates, providers must submit current contact information and verify compliance with all applicable licensure and insurance requirements.

Private providers and private provider firms are required to update their registration within five (5) business days of any change to contact information, licensure status, or insurance coverage.
