Stormwater Permit

A stormwater plan is required for any land development activity by Charlotte County Ordinance 89-37 (Code Section 3-5-111), except for these exempted activities (Code Section 3-5-113):

  1. One (1) residential structure, on an individual site, used for housing.
  2. One (1) duplex structure, on an individual site, used for housing.
  3. One (1) triplex structure, on an individual site, used for housing.
  4. Storage buildings, sheds, swimming pools, and other accessory structures constructed on (1), (2) or (3) above.
  5. Model home used for model home or single-family housing. Additional temporary parking spaces may be installed provided a bond is posted and a letter of intent given to ensure removal when model home usage changes.
  6. Fences.
  7. Any proposal for a development activity causing insignificant impact upon the stormwater facility, as determined by the County Engineer.
  8. Agricultural-related activities which cause insignificant hydrological impacts, as determined by the County Engineer.

The applicant must create and maintain an account on the Citizen Access Portal. Step-by-step instructions on how to submit an application can be found at this link.

Upload all documents to Citizen Access Portal as individual files, using the provided naming convention.  The application is not uploaded as it is an online form, but the form must be completed in its entirety.

    • This document is optional, but if submitted, there is no fee for the review.

Fees

  • If submitted with an approved Water Management District or FDEP permit = No fee
  • For submittals without an approved permit:
    • 10 acres or less = $580
    • Each additional acre = $21.00 per acre or part thereof.
      • Example: The fee for a 10.2 acre site would be $601.00. 
  • Re-submittal after two (2) rejections = $270
  • Plan modification after first approval = $270
  • Stormwater re-inspection fee for each re-inspection = $160

Note: Payments by check should be made payable to either "CCBCC" or Charlotte County Board of County Commissioners. Payments are also accepted by Mastercard or Visa credit or debit cards.

Department Reviews

The review process occurs within the Citizen Access Portal. It typically takes 10 business days to receive the first review or approval, but it can take as long as 30 days depending on the complexity of the project.

  • Intake/Sufficiency: A review of the application and required forms and documents to verify completeness for acceptance and payment of initial fees.
  • Plans Distribution: Plans distributed for review.
  • Stormwater Plans Review: Review of plans. Plans are either approved or rejected with comments that must be addressed. 
  • If approved, the permit is issued.
  • If rejected, the plan review cycle is re-opened.
    • Applicant uploads additional or corrected information or documents.
    • Revised documents received.
    • Plans distributed for review.
    • Second review takes place.
  • Documents are approved and permit is issued. Please print and post the permit/job card in a visible location on site.

Inspections

  • Periodic inspections depend upon the project location and scope of work. Inspections will show on job card.
  • A final inspection will be “pending” until the permit is finalized.
  • To finalize the stormwater permit, a record drawing and certified letter must be prepared, uploaded, reviewed, and approved.
    • A record drawing of the stormwater plan digitally signed by a Florida Registered Professional Engineer must be prepared by the Engineer of Record and accompanied by a signed and sealed letter certifying that the project has been built in substantial compliance with the approved plans. Any deviations from the approved plans must be clearly stated in the Letter of Substantial compliance.
    • Once the record drawings and letter have been prepared, contact the Plan Reviewer, who will assist in uploading the documents to the permit record, and scheduling the inspection.
    • A final inspection of the site will be made. If the inspector finds any deficiencies, the Engineer of Record will be notified of the deficiencies.
      • Upon correction of the deficiencies, notify the inspector to schedule a re-inspection. Every stormwater re-inspection required for the project will require the $160 fee prior to scheduling.
    • Upon acceptance of the record drawing, the permit will be finalized.
       
    • Please note: The stormwater permit remains open until the permit is finalized.
